PRIVACY NOTICE OF GRUPO LAMAS S.A. DE C.V.

 

In compliance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter the "Law"), GRUPO LAMAS S.A. DE C.V. (hereinafter "GRUPO LAMAS "), informs you that the data obtained by contracting products or services with GRUPO LAMAS will be treated confidentially through the systems provided for such purposes and will be used for the operation and registration of the products that you have contracted, as well as to offer you, where appropriate, other products of GRUPO LAMAS or any of its affiliates, subsidiaries, controllers, associates, and promotions of other goods or services related to the aforementioned products.

 

LAMAS GROUP, through this Privacy Notice, you have the opportunity to choose the products and services that we offer you, knowing that your personal data will be protected. The security of your personal information is our priority; That is why we protect this information by maintaining physical, electronic and procedural protections, training our employees in the proper handling of your personal information, in order to prevent unauthorized third parties from accessing it. 

 

In addition to the above, on July 5, 2010 the Law was published in the Official Gazette of the Federation, whose provisions clearly contribute to our objective of protecting your personal data. 

 

By virtue of the foregoing, we inform you that in compliance with the Law, the personal data that we obtain by virtue of the operations that you request or celebrate with GRUPO LAMAS will be treated confidentially through the systems provided for such purposes.  ;

 

RESPONSIBLE FOR THE PROCESSING OF YOUR PERSONAL DATA:

 

The person responsible for the processing of your personal data will be GRUPO LAMAS, which will collect your data to meet your request for a product or service from GRUPO LAMAS, or to formalize the celebration of any product or service. 

 

GRUPO  LAMAS informs you that it possesses, collects or will collect from you, the necessary personal data, mainly for the proper performance and contracting of services and products. Said personal data may have been or may be obtained from you, either personally or directly by any electronic, optical, sound, visual means, or through any other technology. Likewise, we can obtain personal data of which you are the owner, through third parties and from other sources permitted by law, such as credit information companies.

PERSONAL DATA THAT MAY BE COLLECTED: 

 

GRUPO LAMAS will collect the personal data necessary for the formalization of the type of product requested or required by you; including, but not limited to, GRUPO LAMAS may collect:

 

(i)     Identification and contact information: full name, address, home, cell and/or work telephone number, marital status, signature, email, R.F.C., C.U.R.P., place and date of birth, age, number of family members, dependents and beneficiaries, as well as their addresses, among others.

 

(ii)     Labor data: occupation, position, area or department, address, telephone number and work email, work references, personal references and commercial references, among others.

 

(iii)     Financial or patrimonial data: movable and immovable property, credit history, income and expenses, bank accounts, insurance, afores, bonds, contracted services, among others.

 

(iv)     Sensitive personal data: state of health, union affiliation in your case and others that may be so considered.

 

Likewise, in the case of credit products, GRUPO LAMAS is obliged to request additional data that allows it to estimate the feasibility of payment, using an analysis based on quantitative and qualitative information, which allows establishing its credit solvency and payment capacity.  

 

PURPOSES OF THE PROCESSING OF YOUR PERSONAL DATA: 

 

The personal data that GRUPO LAMAS collects will be used for the operation and registration of the products that you have contracted, as well as to offer you, where appropriate, other products of GRUPO LAMAS or of any of its affiliates, subsidiaries, controllers, associates, and send you promotions of other goods or services related to GRUPO LAMAS products.

 

TRANSFER OF PERSONAL DATA: 

 

CAMAS LAMAS may transfer your personal data to Mexican or foreign third parties that provide necessary services for its proper operation, as well as its affiliates, subsidiaries, controllers, associates.

 

In these cases, we inform you that GRUPO LAMAS will adopt the necessary measures so that the people who have access to your personal data comply with the privacy policy of GRUPO LAMAS, as well as with the principles of protection of personal data established in the Law.  ;

 

RIGHTS:

 

You or your duly accredited legal representative may limit the use or disclosure of your personal data; Likewise, as of January 6, 2012, you may exercise, when appropriate, the rights of access, rectification, cancellation or opposition that the Law provides by means of a request submitted at the address indicated above; It is important to mention that the exercise of any of said rights is not a prerequisite nor does it impede the exercise of another right. 

 

Likewise, we inform you that you have the right to initiate a Data Protection Procedure before the Federal Institute of Access to Information and Data Protection (www.ifai.gob.mx) within 15 days following the date on which receive the response from GRUPO LAMAS or from the end of the 20-day period counted from the date of receipt of your request to exercise rights. 

 

MODIFICATIONS TO THE PRIVACY NOTICE: 

 

Any modification to this notice will be notified to you through any of the following means: 

 

1.    A written communication sent to your address

2.    A message sent to your email or 

3.    A message by any electronic means that you use to carry out operations with GRUPO LAMAS; or 

4.    Through a widely circulated newspaper
